1.About these terms

These Terms & Conditions ("Terms") are an agreement between Ocre8 Technologies, Hanuman Nagar Road, Nagpur, Maharashtra, India ("Ocre8", "we", "us", "our") and any person or business that visits our website or places an order with us ("Client", "you", "your").

By making a payment, sending us your photos or materials, or using our website, you confirm that you have read, understood and agreed to these Terms and our Privacy Policy. If you do not agree, please do not place an order.

You must be at least 18 years old and legally able to enter into a contract to place an order. If you order on behalf of a shop or business, you confirm that you are authorised to do so.

2.Our service

Ocre8 creates short AI Powered Promotional Reels ("Videos") for shops, products and services, using the product or shop photos and business name you provide. Videos are made with artificial intelligence (AI) tools together with editing by our team, and are delivered to you on WhatsApp.

Videos are meant for promotion on WhatsApp Status, WhatsApp groups, Instagram, Facebook, YouTube and screens inside your shop, and similar uses.

3.How the order works

1. Contact us on WhatsApp at +91 75881 12566 and choose your package.
2. Pay in full using the payment QR code we send you on WhatsApp. Send us a screenshot or the transaction ID (UTR) after paying.
3. Send your materials on WhatsApp after payment: clear photo(s) of your product or shop, your exact shop or business name, and any logo, offer text or contact details you want shown.
4. We create the first version of your Video and send it on WhatsApp within approximately 2–3 working days.
5. You may ask for one round of changes (see Section 8). We then send the second and final Video.

Work starts only after (a) full payment is confirmed in our account and (b) we have received all the materials needed. The order is considered placed once payment is confirmed.

4.Packages & pricing

• Prices are in Indian Rupees (₹). Any applicable taxes will be told to you before payment.
• Each Video in a package is a separate Video with its own revision limit (Section 8).
• All Videos in a package must be requested within 60 days of payment. Unused Videos after this period lapse and are not refundable.
• We may change prices or packages at any time. Price changes do not affect orders already paid for.

5.Payment

• 100% advance payment is required before any work begins. We do not work on credit or "pay after delivery".
• Payment is made only through the official Ocre8 QR code or payment link sent from our WhatsApp number +91 75881 12566. Do not pay to any other number, person or account claiming to be Ocre8. We are not responsible for payments made to anyone else.
• Please share the payment screenshot or transaction ID (UTR) so we can confirm your payment.
• We never ask for your UPI PIN, OTP, card number or bank password. Never share these with anyone.
• If a payment fails, is reversed or is disputed, we may stop the work and hold back delivery until the payment is settled.

6.Delivery time

• We aim to deliver the first version of each Video within approximately 2–3 working days from the time we have both your full payment and all your materials.
• This is an estimate, not a guarantee. Delivery may take longer during festivals and peak seasons, on Sundays and public holidays, when order volume is high, if your photos are unclear and we need new ones, or because of technical problems with AI tools, internet or power.
• For bigger packages, Videos may be delivered in batches.
• Videos are delivered on WhatsApp to the number you ordered from, unless you ask us in writing to use another number.
• A short delay does not make you eligible for a refund.

7.No refund policy

The only exception: if Ocre8 is completely unable to deliver a Video you have paid for, for reasons on our side, we will, at our choice, either deliver it later or refund the amount for the undelivered Video(s) only.

Payments made by mistake (for example, paid twice for the same order) will be checked against our records and, if confirmed, adjusted or returned.

8.Revisions & final video

• Each Video is delivered in a maximum of two (2) versions:
  1. Version 1: the first Video we send you.
  2. Version 2 (Final): made after your one round of requested changes. This is the final Video.
• Send all the changes you want together, in one message, within 3 days of receiving Version 1. If we receive no feedback within 3 days, Version 1 is treated as the final Video.
• Revisions cover small changes, such as text, spelling, shop name, phone number, offer details, music, or swapping or trimming scenes. A completely new idea, a different product or new photos count as a new Video and must be paid for separately.
• After the final Video is delivered, further changes may be done as a paid extra, at our discretion.
• Because of how AI works (Section 10), some things cannot be fully controlled even in a revision. We will make reasonable efforts, but we cannot promise any exact result.

9.Video length & format

• Each Video is up to 40 seconds long, and may be shorter depending on the content.
• Videos are usually delivered in vertical 9:16 format (for Reels and Status) as MP4 files. Other formats may be provided on request where possible.
• WhatsApp may reduce video quality when sending. On request, we can share the file as a WhatsApp "document" to keep the quality.
• We do not provide project files, raw AI files, prompts or editing files.

10.AI-generated content terms

Our Videos are created using artificial intelligence tools. By ordering, you understand and accept that:

• AI output may differ from your actual product or shop. Colours, shapes, labels, packaging, text, backgrounds or small details may look slightly different, enhanced or stylised compared to your original photo.
• AI may create small mistakes, such as unusual movement, distorted objects, extra or missing details, or incorrect spelling in text. We review each Video, but some imperfections are a normal part of AI content.
• Results depend on your photo. Clear, well-lit, high-resolution photos give better results. Blurry, dark or cluttered photos may give weaker Videos, and this is not grounds for a refund.
• Results are not unique. AI tools may produce similar styles, music, effects, backgrounds or scenes for other customers. We do not promise that your Video will be exclusive or unlike any other content.
• Copyright in AI material is not settled. The law on copyright in AI-generated content is still developing in India and worldwide. Ocre8 does not claim copyright over the AI-generated parts of your Video. Your own photos, logo and brand name stay yours.
• Check before you publish. Look at every Video carefully before you post it. You are responsible for making sure what is shown (product, price, offer, claims) is accurate and not misleading to your customers.
• Disclose AI content where required. Some platforms, such as Instagram, Facebook and YouTube, require or recommend labelling AI-generated content. Following platform rules is your responsibility.
• Our AI tools are run by other companies. To make your Video, your photos and text may be processed by third-party AI services, as explained in our Privacy Policy.
• We will not use AI to create fake or misleading depictions of real people (deepfakes), or to copy another brand's identity.

11.Your photos, logo & brand

What you promise us

When you send us photos, logos, brand names, product names, text or any other material ("Client Material"), you confirm that:

• You own the Client Material, or have full permission from the owner to use it for advertising.
• The shop or business name, logo and trademarks belong to you, or you are an authorised dealer, distributor or franchisee allowed to use them in your advertising.
• Any person whose face appears in your photos has given consent to appear in an advertisement.
• The Client Material does not infringe anyone's copyright, trademark, privacy or other rights, and does not break any law.

Permission you give us

You give Ocre8 a non-exclusive, royalty-free permission to use, edit, enhance, and process (including through third-party AI tools) your Client Material only for the purpose of creating your Videos, and for portfolio use as described in Section 14.

Other brands

If your products carry other companies' brand names or logos (for example, a mobile phone, paint or electronics brand), you are responsible for making sure you are allowed to show them in your advertising. Ocre8 does not check authorisation and is not responsible for any claim made by a brand owner.

We may refuse any order or Client Material that we believe infringes someone's rights or breaks these Terms. In that case the no-refund policy applies, unless we decide otherwise.

12.Stock media & third-party material

Apart from your Client Material, Videos may include background visuals, effects, music, sounds, fonts or other elements ("Supporting Elements"). Ocre8 will only use Supporting Elements that are:

• created by AI tools for your Video;
• made by our team; or
• taken from licensed, royalty-free or stock libraries whose licence allows commercial use in advertising.

Ocre8 does not claim ownership of third-party stock media, music or fonts; these remain the property of their owners and are used under their licences. Your right to use them is limited to using the Video as delivered.

• Do not extract music, clips or other Supporting Elements from the Video to use separately.
• Social media platforms may sometimes flag or mute music automatically, even when it is licensed. If this happens, tell us and we will provide a version with different or no music, as reasonable help. Ocre8 is not responsible for platform decisions.
• If an owner of any element raises a valid claim, we will help by replacing that element in the Video.

13.Ownership & usage rights

• After full payment and delivery, you may use the final Video, without time limit, to promote your own shop, products or services, on any platform, online or offline, including paid ads.
• You may not resell, sublicense or redistribute the Video as a product, or claim that you created it as a video service for others.
• You may trim or crop the Video for your own use. Ocre8 is not responsible for any edits you or others make.
• Ocre8 keeps all rights in its own templates, styles, prompts, workflows, know-how and creative methods, and may use them for other clients.

14.Portfolio use by Ocre8

Unless you tell us in writing (WhatsApp or email) before delivery that you do not want this, you allow Ocre8 to show your Video, and your business name, on our website, Instagram, Facebook, WhatsApp and other marketing as an example of our work.

If you change your mind later, message us and we will remove it from our website and future posts within a reasonable time. We cannot recall copies already shared by others.

15.Use of the Ocre8 name & logo

• "Ocre8", "Ocre8 Technologies", "Ocre8 AI Powered Promotional Reels" and the Ocre8 logo belong to Ocre8 Technologies.
• You may not use our name or logo in a way that suggests a partnership, sponsorship, franchise or endorsement, or to sell similar services, without our written permission.
• Ocre8 may add a small "Made by Ocre8" credit to Videos only if this is agreed with you before the order. Please do not remove any credit that was agreed.
• You are welcome to tag @ocre8_technologies when you post your Video.

16.Prohibited content

We will not create Videos for, and you may not use our Videos for:

• illegal products or services, including drugs, weapons, gambling, betting or illegal financial schemes;
• tobacco, alcohol or other products whose advertising is restricted by Indian law;
• false, misleading or unproven claims (for example, "guaranteed cure" or fake discounts);
• content that is obscene, hateful, defamatory, communal, political or that targets any religion, caste, community or person;
• copies or imitations of another company's brand, logo or advertisement, or counterfeit products;
• photos of people used without their consent, or content involving minors in an inappropriate way;
• anything that breaks the Consumer Protection Act, 2019, the Information Technology Act, 2000, advertising standards, or platform rules.

We may cancel an order that breaks this Section. No refund will be given in that case.

17.Your responsibilities after delivery

• Download and save your Videos. We keep delivered files for a limited time only (see our Privacy Policy) and do not promise to re-send them later.
• Check prices, offers, phone numbers and spellings in the Video before publishing.
• Make sure all offers shown in the Video are real and honoured at your shop.
• Follow the rules of the platforms where you post the Video.

18.Limitation of liability

• Videos are promotional material. We do not guarantee any specific number of views, likes, followers, customers, leads or sales.
• We are not responsible for losses caused by: errors in information you provided; your use or edits of the Video; the actions of social media platforms (including removal, muting or account restrictions); third-party claims arising from your Client Material; or events beyond our control (such as natural disasters, network failures or government action).
• To the maximum extent allowed by law, Ocre8's total liability for any claim related to an order is limited to the amount you paid for that order.
• We are not liable for any indirect or consequential loss, such as loss of profit, business or reputation.

19.Indemnity

You agree to protect and compensate Ocre8, its owners and team against any claim, loss, penalty or legal cost that arises because:

• your Client Material infringes someone else's rights;
• you used the Video in a misleading, unlawful or unauthorised way; or
• you broke these Terms.

20.Offers & promotions

Special offers (such as the Diwali offer) are valid only for the period stated, for example until 5 November 2026, and only for payments received within that period. Offers cannot be combined unless stated, and cannot be exchanged for cash. Ocre8 may end or change an offer at any time without affecting orders already paid for.

21.Changes to these terms

We may update these Terms from time to time. The latest version will always be on this page with its "Last updated" date. The version in force on the date of your payment applies to that order.

22.Governing law

These Terms are governed by the laws of India. We will first try to settle any dispute through friendly discussion on WhatsApp or email. If it cannot be settled, the courts at Nagpur, Maharashtra will have exclusive jurisdiction.

If any part of these Terms is found to be unenforceable, the rest of the Terms will remain in force.
